Welcome to The Universe Awakes! By visiting our website and purchasing our products, you agree to the terms laid out here.

1. Who we are

This website is operated by The Universe Awakes, a California-based business specializing in original astrophotography prints. The terms “we”, “us”, and “our” refer to UniverseAwakes. By using this site or purchasing a product, you agree to these Terms of Service (“Terms”).

2. Eligibility & your use of the site

You must be at least 18 years old (or the age of majority in your location) to use this site or make a purchase. If you’re under 18, please browse with a parent or guardian.

Don’t use this site for anything illegal or harmful. That includes transmitting malicious software, trying to access restricted parts of our site, or using our content or products for unauthorized resale or distribution.

3. Our products

We sell custom astrophotography prints featuring my original images. While we do our best to accurately represent the colors and materials in our store, your screen or monitor may display them a little differently. Images are for illustrative purposes only.

We may change or discontinue products without notice. All products are subject to availability, and we reserve the right to limit sales at our discretion.

4. Orders, payments & billing

All prices are listed in U.S. dollars and may change at any time. Orders are processed when you submit them. We accept payment via PayPal and all major credit cards. Full payment is due at the time of ordering. 

It’s your responsibility to provide accurate and up-to-date billing and shipping info. If we need to contact you about your order, we’ll use the info you gave us.

5. Shipping & delivery

We ship to most locations worldwide. Shipping rates and delivery estimates are provided at checkout. Delivery times are estimates only — delays outside our control (like weather or carrier issues) may occur. If your order arrives damaged or doesn’t show up, please contact us within 14 days of the shipping date and we’ll work to make it right.

6. Returns & refunds

All sales are final due to the custom nature of our prints. That said, if your order is damaged or incorrect, let us know within 14 days of delivery and we’ll offer a replacement or refund where appropriate.

7. Intellectual property

All images, text, and designs on this website — including all astrophotography — are the original work of The Universe Awakes and are protected by copyright and other intellectual property laws.

You may not use, copy, distribute, modify, or sell any part of our content without our express written permission. We take unauthorized use seriously.

8. Third-party tools & links

Our site may contain links to third-party services or allow access to third-party tools (like shipping calculators). These are provided “as-is” without any warranties. We’re not responsible for third-party content or your use of those services.

9. Limitation of liability

To the fullest extent permitted by law, The Universe Awakes will not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of the site or purchase of our products. Our total liability, if any, is limited to the amount you paid us for the product in question.

10. Indemnification

You agree to indemnify and hold us harmless from any claim or demand, including reasonable legal fees, arising from your breach of these Terms, your misuse of the site, or your violation of any law or rights of a third party.

11. Changes to these terms

These terms are effective March 24, 2025. We may update these Terms at any time. If we do, we’ll post the changes here. Your continued use of the site after changes are posted means you accept those changes.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Any disputes will be resolved in the courts located in Santa Clara County, California.
